Terms and conditions of sale

Who is selling, what happens when you order, and what you can do if you change your mind.

This document cannot be published yet. The seller’s VAT number and legal form are missing, and under Italian law both are required for distance selling. While the fields marked below are empty, the shop must not be opened to the public.

1. Who is selling

2. Who these conditions apply to

They apply to every purchase made through this site. If you are buying for purposes outside your trade or profession you are a consumer, and you have the protections of the Italian Consumer Code (Legislative Decree 206/2005), which implements the EU Consumer Rights Directive — including the right of withdrawal described in section 6. If you buy with a VAT number in the course of your business, the right of withdrawal does not apply.

If you live in another EU country, the mandatory consumer rules of your own country continue to apply to you in addition to these conditions.

3. The products

What is sold here is ceramic shaped and decorated by hand. These are not industrial products: differences in the tone of the glaze, small irregularities at the rim and variations in the pattern are features of the making, not faults, and are not grounds for complaint.

The photographs describe each piece as faithfully as possible, but how the colours look also depends on your screen. Where a piece is one of a kind, its page says so: once sold, that piece does not come back.

Guidance on how each object may be used is given on its own page. Where nothing is stated, the object is to be treated as decorative.

4. Prices

Prices are in euro and include VAT. Shipping is not included in the price of the piece: it is calculated and shown separately in the basket, and the complete total is put in front of you before you confirm the order.

5. How the contract is formed

  1. You put pieces in the basket and go to the checkout.
  2. You see a complete summary: pieces, prices, shipping, total and delivery details. Up to this point you can change anything.
  3. You confirm the order. That confirmation counts as an offer to buy.
  4. You receive a confirmation email with the summary. The contract is formed when you receive that email.

If a one-off piece turns out to have been sold already to an order that arrived first, your order is not accepted and anything you have paid is refunded in full.

6. Right of withdrawal: fourteen days

If you are a consumer you have fourteen days to withdraw without giving any reason. The period runs from the day on which you, or a third party you have named, take physical possession of the goods.

How to exercise it

An explicit statement sent to info@chianticeramica.it within the fourteen days is enough; give the order number and the piece. No particular form is required; if you prefer, you may use the model withdrawal form in Annex I, part B of the Italian Consumer Code.

Returning the piece

The piece must be sent back within fourteen days of your statement, undamaged and packed well enough to survive the return journey. A piece that arrives back broken because it was badly packed means the refund is reduced by the loss in value.

Refund

The refund is made within fourteen days of the returned piece arriving, by the same means of payment you used, unless we agree otherwise. It includes the standard delivery charge, but not any supplement you chose to pay for a faster delivery.

When withdrawal does not apply

Withdrawal does not apply to goods made to your specification or clearly personalised, under article 59 of the Italian Consumer Code. That covers pieces commissioned to your own instructions as to shape, size, pattern or lettering. This exclusion is put to you in writing before you confirm the commission: if it was not told to you beforehand, it does not apply.

7. Legal guarantee of conformity

Goods sold to consumers carry the legal guarantee of conformity: the seller is answerable for defects in conformity that appear within twenty-four months of delivery. To rely on the guarantee, write to info@chianticeramica.it describing the defect, with photographs if you can.

Outside the guarantee are the variations in tone and the irregularities inherent in hand-making, described in section 3, and damage from misuse or from being dropped.

8. Damage in transit

If the parcel arrives visibly damaged, accept the delivery with a written reservation on the carrier’s note and photograph the box before you open it. Without the reservation and without photographs of the packaging, the carrier rejects the claim and the loss cannot be recovered.

9. Governing law and disputes

Italian law governs the contract. For a consumer, the competent court is that of your place of residence or elected domicile if it is in Italy; otherwise the competent court is Florence. If you are resident in another EU country, this does not deprive you of the protection of the mandatory rules of your own country.

10. Changes

These conditions may change. The version that applies to an order is always the one in force when you sent it, and that version is summarised in your confirmation email.
